Delamode Group Privacy Policy

This Privacy Policy provides information about the processing of personal data by Delamode Group companies in accordance with the European Union’s General Data Protection Regulation 2016/679 (EU) (the „GDPR“).

This Privacy Policy also describes your rights as a data subject, the provision of data to recipients, and other personal data processing terms applicable to all personal data processed by the Delamode Group for the purposes set out in this Privacy Policy. Terms used in this Privacy Policy shall have the meaning given to them in the Regulation, unless otherwise specified in this Privacy Policy.

Who is the controller of your personal data?

In managing your personal data, the Delamode Group follows common principles and procedures for the processing of personal data and, together, determines the purposes and means of the processing of your data in accordance with the data sharing agreement between the companies in the Delamode Group. This Delamode Group Companies Agreement sets out how the companies within the Delamode Group share responsibilities for the protection of your personal data, how they cooperate to ensure that your rights are properly exercised and that you are clearly informed about the processing of your data. All companies in the group are committed to complying with data protection requirements and to processing the data they jointly control in a fair and lawful manner. Technical and organisational measures are in place to protect the security of your data against unauthorised use, loss, alteration or destruction.

At the same time, please note that, notwithstanding the agreement on joint data management, each group company also acts as an independent controller, determining the purposes and means of the processing of your personal data.

The controller of your personal data is the specific company or companies within the Delamode Group to which you have provided your personal data in connection with an existing or envisaged contractual or pre-contractual relationship, whose services you use or intend to use, or to which you have provided your personal data for any other reason. Depending on the purposes for which your personal data is processed (e.g. where several companies of the Delamode Group are involved in the transport of your shipment), the controller of your personal data may be one or several companies of the Delamode Group. Who is this Privacy Policy for?

The terms and conditions set out in the Privacy Policy apply to individuals when visiting the Delamode Group’s website(s), when using or intending to use the Delamode Group’s services, when communicating with Delamode Group companies and when otherwise submitting personal data.

What are the principles of personal data protection followed by the Delamode Group?

The following principles apply to the collection and use of your personal data provided by you and from other sources:

What personal data are processed and for what purposes and how long will they be kept?

Below you can find information on the possible purposes, scope and retention periods of the processing of your data.

We do not keep your personal data for longer than the purposes of the processing or the law requires, if it provides for a longer retention period. The data may be kept for longer periods of time if this is necessary for the protection of the rights of the Delamode Group against claims, demands or actions, or if it is necessary for an investigation or as evidence in a civil, administrative or criminal case. We retain personal data collected for the purpose of concluding or performing a contract at least until the end of the contract and up to 10 years after the end of the contract in order to protect our legitimate interests and to comply with legal requirements (e.g. in relation to bookkeeping and data retention). If the applicable legislation provides for a specific mandatory retention period, we will comply with that period.

Employee or trainee recruitment and administration of the candidate database for employment or traineeship positions If you have applied to us for a job or traineeship position based on an advertisement published on our website, on a specialized recruitment or job/traineeship search website, or through our recruitment partner. Name, surname, date of birth, phone number, email address, residential address, CV, cover letter if provided, information about work experience, education, training, competences, current and former workplaces, driving category and driving experience where relevant to the job function, references, and other data voluntarily provided by you in your CV and/or other submitted documents.

Please note that, exercising the rights provided by personal data protection legislation, we may contact your previous employers and ask for their opinion about your qualifications, professional skills and work-related qualities. However, your current employer will not be contacted without your clearly expressed prior consent.
Where you apply for a specific job or traineeship position announced by us or our partner, we will process your personal data in order to take steps at your request before entering into a contract (Article 6(1)(b) GDPR).

Where you submit your application not for a specific position, we will process your personal data based on your consent (Article 6(1)(a) GDPR).

After the selection process ends, we will store your personal data based on our legitimate interest so that, if a new employee is needed, we can contact you and invite you to participate in a new selection process or make a job offer (Article 6(1)(f) GDPR).
Providing your personal data to participate in the selection process is voluntary, but if you do not provide the data, we will not be able to assess your suitability and conclude or perform an employment or traineeship contract.

You may object to the retention of your data after the selection process ends. In that case, we will delete your personal data and will not send you future job offers unless you voluntarily participate in a new selection process or send your data again. If you do not agree to the storage of your data after the end of the selection process, please inform us by sending your CV and other data, replying to an email or signing an information form during a meeting.

Certain actions may also be carried out in order to comply with statutory obligations related to employment or traineeship relationships.
For the purpose of recruitment for a job or traineeship position, we will process your personal data until we decide to hire a specific candidate, until the end of their probationary period, or until we decide to close the selection without selecting any candidate. If you do not object to such processing, after the end of the selection process we will store your CV and other submitted data for candidate database administration purposes for 3 years from the receipt of your consent. Where we are legally obliged to examine your enquiry, we process your personal data based on compliance with legal requirements (Article 6(1)(c) GDPR).

Where your enquiry is related to contract performance, we process your personal data based on contract performance (Article 6(1)(b) GDPR).

Where a dispute may arise or has arisen, we process your personal data based on our legitimate interest in clarifying the circumstances and properly examining received claims and complaints (Article 6(1)(f) GDPR).
You are not obliged to provide this data, but if you do not, your rights or legitimate interests may not be implemented or may be implemented improperly. If your enquiry is related to a potential dispute, possible damage or similar circumstances, your personal data may be stored for a maximum period of 10 years.

If the personal data related to the enquiry is not related to a potential dispute, it will be stored for 1 year from the date of submission of the enquiry.

You are not obliged to provide this data, but in that case we may not be able to perform the contract or properly provide services to you. If information related to contract performance or compliance with legal requirements applicable to us is provided during your electronic communication, your personal data may be stored for a maximum period of 10 years.

If other information and data is provided during your electronic communication, it will be stored for 1 year from the date of submission of the electronic communication message.

When you use a social network, communicate with the Delamode Group on a social network, visit an account on a social network or view posts there, we also receive information about you. The scope of data received depends on the account settings selected by us, agreements with the social network operator for additional services, and cookies set by the social network operator.

You are obliged to provide this data. If you do not provide your personal data, we will not be able to perform the contract concluded with you and provide services to you. We will store your personal data for no longer than 10 years from the completion of the cargo acceptance, storage or delivery service. Preparation of cargo damage/non-conformity documents When cargo damage/non-conformity is identified during the acceptance or delivery of your cargo and we must prepare a document confirming cargo damage/non-conformity. Our legitimate interest in clarifying the circumstances and properly examining received claims and complaints (Article 6(1)(f) GDPR).
You are obliged to provide this data. If you do not provide your personal data, we will not be able to perform the contract concluded with you. Conclusion and performance of contracts or orders, provision of services When you and the Delamode Group conclude and perform contracts or orders for the provision of Delamode Group services or on another basis.
